Contract T&A

This agreement contains the entire understanding between 31:3 Photography and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. It is understood that even with the signing of a contract and/or verbal agreement, no day or time slot is reserved without a deposit.

31:3 Photography agrees to provide the professional photography services as selected and detailed in the Client’s specific Statement of Work (SOW) or Digital Invoice. The selected package—including the total hours of coverage, number of photographers, and specific deliverables (such as the quantity of edited images and film length)—is hereby incorporated into this Agreement by reference. Any upgrades or additional services requested by the Client after the signing of this Agreement will be documented in an updated SOW and may be subject to additional fees

Session Creative Consultation: To ensure your story is told with intention, we will connect prior to your session date to align on your vision, styling, and location. 31:3 Photography can provide guidance on lighting and logistics, serving as a partner in your creative process. We invite you to share any inspiration or wardrobe changes ahead of time, ensuring our session remains seamless and focused on what matters most.

Retainer: A non-refundable retainer fee of 50% of the chosen package is required to hold your date. The remaining balance is due at the time of the shoot or 24 hours prior.

  • If final payment is not received, 31:3 Photography reserves the right to withhold image delivery or decline the session.

  • The retainer must be paid within 3 days of signing, or the contract becomes null and void and the time slot will be released.

Cooperation & Preparation: To achieve the best results, the Client is responsible for being session-ready (hair, makeup, and wardrobe) at the start of the scheduled time. While we use professional discretion to capture your best angles, 31:3 Photography is not responsible for the impact of wardrobe choices or uncooperative subjects on the final images.

Turnaround Time: Edited photos will be delivered via a private online gallery within 2 weeks.

  • RAW images are not provided as they are unfinished archives.

  • 31:3 Photography uses professional judgment to select the best images (quantity as specified in your chosen portrait package) to represent your visual legacy.

The Schedule: Punctuality is essential for portrait sessions. Because sessions are often booked back-to-back, late arrival will result in that time being deducted from your total session length. Arrival more than 25 minutes late constitutes a "No-Show," and the session will be cancelled with the retainer forfeited.

Travel Expenses: If travel is required for the Photographer, the Client is responsible for all travel and transportation expenses. Sessions more than 30 miles outside of Houston incur an extra travel fee of $1.00 per mile, which will be invoiced separately. Any location-specific fees or permits (e.g., studio rentals or park entry fees) are the responsibility of the Client.

Change of Date or Location: Photographers must be notified immediately of any changes to the schedule or venue. One complimentary reschedule is permitted with at least 48 hours' notice. Rescheduling with less than 48 hours' notice may incur a re-booking fee. In the event of extreme weather (inclement rain or heat above 100°F), 31:3 Photography reserves the right to reschedule to the next available date at no cost to the Client.

Exclusivity & Conduct: 31:3 Photography shall be the exclusive professional photographer retained for the session. To maintain a focused creative environment, we request that guests refrain from taking photos that interfere with the Photographer's work. 31:3 Photography reserves the right to terminate the session if any person behaves in an inappropriate or hostile manner.

Cancellation: All monies paid are forfeited upon cancellation unless caused by a documented unforeseen medical emergency (excluding travel expenses). If the Client cancels and does not wish to reschedule, the retainer is non-refundable.

Copyright & Model Release: Copyright remains with 31:3 Photography. Images are for personal use (printing/sharing). Sale, publication, or commercial use for business purposes requires separate written permission.

  • Model Release: The Client grants 31:3 Photography consent to use images for editorial, advertising, or portfolio purposes to showcase the brand’s work.

Social Media Tagging" Courtesy: We love seeing your legacy shared! When posting to social media, please tag @31.3photography and avoid using Instagram/TikTok filters over the images. Our editing is part of the cinematic experience you invested in, and we want it to look its best!"

Limit of Liability: If the primary photographer is unable to attend due to illness/injury and a reschedule cannot be agreed upon, liability is limited to a full refund of payments received. In the unlikely event of digital file loss or damage, liability is limited to a prorated refund based on the percentage of images delivered.
